Delhi Court Ruling Against Google May Transform India’s Online Advertising Market
A Delhi High Court ruling against Google could have far-reaching implications for India’s online advertising industry. The court found that Google infringed the trademark rights of bathroom fittings manufacturer Hindware by allowing competing companies to use the brand’s name as a keyword for online advertisements. Google has been ordered to pay damages of $31,600.
The court said Google’s advertising system effectively allows trademarks to be sold or auctioned to advertisers without authorization from the trademark owner. In response, Google stated that it complies with local laws and addresses legal concerns through the appropriate judicial process when disputes arise.
The decision has drawn strong support from business leaders and brand owners across India. Entrepreneurs including Zerodha founder Nithin Kamath and Shaadi.com founder Anupam Mittal said the ruling could provide companies with legal recourse against competitors bidding on their brand names. Industry observers believe the judgment could significantly alter the economics of digital advertising in one of Google’s most important global markets.
