Opposition MPs approach SC to challenge RS speaker’s move to reject impeachment motion

The Rajya Sabha members, who recently filed an impeachment motion against CJI Dipak Misra, have approached the top court of the country to challenge Upper House speaker M Venkaiah Naidu’s move to reject the motion filed against the Chief Justice for abuse of power.

The petition has been filed by Partap Singh Bajwa and Dr Amee Harshadray Yajnik. Senior advocate Sunil Fernandes has represented the petitioners in the top court.

The petition has alleged that the Rajya Sabha speaker has no authority to reject the petition which has the support of more than fifty lawmakers. The petition has further claimed that the speaker assumed himself the power of a quasi judicial authority, the power which is not granted to the speaker by the constitution, in order to carry out such an act.

The petition has been mentioned before a Supreme Court bench of Justice J Chelameswar and S K Kaul. It is believed that it is because the allegation in the petition has been directed against the Chief Justice the petition has been mentioned before a special bench headed by one of the senior most judges.

It is learned that some senior lawyers such as advocate Kapil Sibal will represent the petitioners in the case.
