Nestle Wins Trademark Battle Against Shankeshwar Utensils Over “Maggisun”

The Delhi High Court has closed a trademark infringement case filed by Nestle S.A., the parent company of Maggi, against Shankeshwar Utensils & Appliances Private Limited after the two parties reached a settlement. Justice Tejas Karia approved the settlement, under which Shankeshwar Utensils agreed not to manufacture or sell pressure cookers or any other products under the “Maggisun” brand or any mark resembling Nestle’s “Maggi.” The defendant also committed to destroying all existing products bearing the mark and cancelling its trademark registration for “Maggisun.”

Nestle, which acquired the Maggi brand in 1947, had filed the suit in 2018, alleging that the use of “Maggisun” infringed on its trademark rights. As part of the settlement, Shankeshwar Utensils acknowledged Nestle as the rightful owner of the MAGGI trademark and accepted the validity of all its registrations. The company also agreed not to advertise Maggisun, Maggi, or any similar trademark across print, electronic, social media, or e-commerce platforms.

Maggi continues to maintain a strong presence in India, its largest market globally, with six billion servings sold in FY24. Despite a controversial past—including a five-month ban in 2015 over excess lead content—Nestle India has expanded its product portfolio with over 140 launches in the last eight years and plans to invest ₹7,500 crore by 2025 to further strengthen its operations in the country.
