Indian Government on WhatApp’s Lawsuit

The government in response to WhatsApp moving to the Delhi High Court against the new rules that demands it to break end-to-end encryption stated that it respects the Right to Privacy and has no intention to break it.

However, it said compliance requirement is necessary for public interest and identifying the first originator of messages leading to crimes. Union Minister for Electronics, IT, and Law, Ravi Shankar Prasad, in a statement made it clear saying the right to privacy is absolute and is subjected to reasonable restrictions.

The new Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 were announced by the government on February 25 and required large social media platforms like Twitter, Facebook, Instagram, and WhatsApp to comply with the norms by May 25.
