Role of the Police
The police force plays a vital role in the maintenance of law and order in society. It is a source of confidence and security to individuals who seek to live peacefully in society. Also, police officials are the proper authority to enforce Intellectual property rights. Therefore, police officials need to be given adequate powers to conduct search and raid operations at the inland location of the importer (or end-user) once counterfeit and pirated goods are detected.
As things stand, there are adequate provisions for imposing damages or punishing the infringer. What is required is greater awareness of these laws within the Police force so that they are able to deter counterfeiters from repeating the offence. It is also important to build a strong and durable partnership between the right holders and enforcement agencies, to strengthen mutual co-ordination and facilitate institutional linkages between Industry and Enforcement authorities, for better enforcement of intellectual property in the country. It is commendable that CII has taken the lead at the national level to further this objective.
