Indian Tribunal Suspends WhatsApp-Meta Data Sharing Ban, Easing Pressure on U.S. Giant
India’s National Company Law Appellate Tribunal (NCLAT) has temporarily suspended a five-year ban on data sharing between WhatsApp and its parent company, Meta Platforms, imposed by the Competition Commission of India (CCI). The CCI’s November ruling aimed to prevent WhatsApp from sharing user data with other Meta entities for advertising purposes, a move Meta warned could disrupt its operations and force the rollback of certain features. The NCLAT noted that the ban could collapse WhatsApp’s business model, providing temporary relief as it continues to hear Meta’s challenge to the antitrust directive.
India, Meta’s largest market with over 500 million WhatsApp users and 350 million Facebook users, plays a critical role in the company’s growth. Meta argued that the CCI lacked the technical expertise to understand the implications of its order and claimed the privacy policy changes were intended to explain optional business messaging features rather than expand data sharing. The suspension allows Meta to continue its current operations, including ad personalization for businesses, while the case remains under review.
The CCI’s ruling followed criticism of WhatsApp’s 2021 privacy policy update, which was accused of coercing users into accepting data-sharing terms. Meta welcomed the NCLAT’s decision, stating it would evaluate next steps, while the CCI retains the option to challenge the suspension in the Supreme Court. In Europe, WhatsApp faced similar scrutiny and later agreed to clarify policy changes to comply with EU laws.
