EB-5 Visa Warning Signals Possible Setback for Indian Investors
The May 2026 US Visa Bulletin has issued a significant warning for Indian investors, indicating that rising demand in the EB-5 Unreserved category could soon lead to visa retrogression or even temporary unavailability. The US State Department cautioned that increased usage by Indian applicants may exceed the annual cap for FY2026, potentially forcing authorities to move priority dates backward. This would result in longer waiting periods for green card processing, especially for those who currently have “current” status under the category.
The EB-5 Immigrant Investor Program, which grants US permanent residency to foreign nationals investing in job-creating enterprises, has seen a surge in Indian participation in recent years. Experts attribute this trend to factors such as long backlogs in EB-2 and EB-3 visa categories, policy changes affecting H-1B and H-4 visa holders, and the appeal of concurrent filing benefits that allow applicants to secure work and travel permits while their petitions are pending. India now accounts for a substantial share of global EB-5 applications, making it one of the fastest-growing participant groups.
Immigration specialists warn that the programme is entering a “pre-retrogression” phase, with the next few Visa Bulletins proving critical. While EB-5 Reserved categories—such as rural and infrastructure projects—remain current for now, investors are advised to act quickly, especially ahead of the September 30, 2026 filing deadline. Filing early can help secure a place in the queue and reduce risks associated with future backlogs, as the EB-5 route continues to be viewed as a viable long-term immigration pathway despite emerging uncertainties.
