India’s Antitrust Raids on Media Buying Agencies Triggered by Leniency Tip-offs

India’s Competition Commission (CCI) conducted raids this week on the local offices of WPP-owned GroupM, Interpublic, Publicis, and Dentsu, along with the Indian Broadcasting and Digital Foundation (IBDF), over suspected collusion on ad pricing and discounts. The investigation was initiated under the CCI’s leniency program, which grants penalty waivers to companies that voluntarily disclose evidence of anti-competitive practices. According to sources, Japanese firm Dentsu was among those that applied for leniency, providing details about alleged pricing arrangements between the Advertising Agencies Association of India (AAAI) and IBDF.

The raids, lasting over 24 hours, aimed to gather evidence on suspected cartel-like behavior in India’s $18.5 billion advertising market, which is projected to grow 9.4% in 2025. The probe follows major shifts in the industry, particularly after the $8.5 billion merger of Walt Disney and Reliance’s Indian media assets, which now hold a dominant 40% share of TV and streaming ad revenue. If found guilty, the media agencies could face hefty penalties of up to three times their annual profits from the collusion period or 10% of their yearly turnover.

The CCI has remained silent on the matter, while AAAI and IBDF have not responded to queries. Global advertising giants GroupM, Interpublic’s IPG Mediabrands, and France’s Publicis Groupe also declined to comment. The case is expected to unfold over the coming months, following past instances like the 2018 beer industry cartel investigation, where AB InBev received a full penalty waiver for exposing industry-wide price-fixing.
