Should we legalise gambling, asks law commission

The gambling is one of the areas in which the government has no clear laws. Different states have different laws related to the gambling as the constitution allows them to create their own laws in that area. This makes the gambling sector highly vulnerable to the malpractices. It is an undisputed fact that the laws related to this area are unfit to deal with the challenges posed by the digital era. It is apparent that the Public Gambling Act of 1867, the one and only act which deals with the gambling, has no clear directives on the online gambling which is one of the biggest issues faced by the country at this moment. Moreover, the Information Technology Act of 2000, which is supposed to cover all these areas, vaguely covers this area.

On the wake of this situation, identifying that it is impossible to regulate the gambling with the existing law, the Law Commission, as it had been earlier directed by the Supreme Court of India to study the possibility of the legalisation of the gambling, has sought public’s views on a proposal seeking the legalisation of gambling. It seems that the law commission wants to know whether the gambling in any way hurt the moral system of our country. Experts say that the law related to the gambling should be upgraded and amended to enable it to face the challenges posed by the new era.
